1. Acceptance of Terms
By accessing or using the Customatic Platform, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
2. Service Description
Customatic is a software-as-a-service (SaaS) platform that provides automation tools for customs documentation, tariff classification, and ASYCUDA XML generation. We are not a licensed customs broker.The Platform is intended for use by licensed customs brokers, importers, exporters, and qualified trade professionals.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
4. Customs Disclaimer
The Platform provides automation tools only and does not constitute legal or professional customs advice. All HS code classifications, duty calculations, and documentation outputs are advisory only. You are solely responsible for verifying all information before submission to customs authorities.
5. Prohibited Uses
You may not use the Platform to submit false or fraudulent customs declarations, evade duties or taxes, process prohibited goods, or violate any applicable export control or sanctions laws.
6. Subscription & Billing
Subscriptions automatically renew unless cancelled before the end of the current billing period. You authorize us to charge your payment method for renewal fees. Price changes require 30 days notice.
7. Refund & Cancellation
You may cancel your subscription at any time through account settings. Cancellation takes effect at the end of the current billing period. Monthly subscriptions are generally non-refundable.
8. Limitation of Liability
To the maximum extent permitted by law, Customatic shall not be liable for any customs penalties, fines, additional duties, delays in clearance, or any losses arising from inaccurate or incomplete declarations prepared using the Platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the event.
9. Intellectual Property
All platform IP remains the property of Customatic. You retain ownership of your data and generated content.
10. Termination
We may suspend or terminate your account for violations of these Terms. Upon termination, your data will be retained for 90 days then securely deleted.
11. Governing Law
These Terms are governed by the laws of Barbados. Any dispute shall be resolved through binding arbitration in Bridgetown, Barbados.
